By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, Return and Exchange Policy, and Shipping and Delivery Policy (collectively, the "Policies," available on the Website). These Terms apply to all users of the Services, including individuals and entities ("You" or "Your"). We may update these Terms periodically by posting the revised version on our Website with an updated "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

Eligibility

To access certain features, such as order tracking, personalized recommendations, or saved payment methods, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities conducted under your account.

Product Descriptions

We strive to provide accurate descriptions of our jewelry products, but certain limitations apply:

  • Diamond Weights: All diamond weights, including Carat Total Weight (CTW), are approximate and may vary slightly from the stated values.
  • Product Images: Items displayed on the Website may be enlarged or enhanced to show details for clarity. Actual products may differ slightly in appearance due to photographic, lighting, or display variations.
  • Errors: Candy Jewelers is not responsible for printing, photographic, clerical, or typographical errors in product descriptions, pricing, or other content. We reserve the right to correct any errors, inaccuracies, or omissions and to update or cancel orders affected by such errors at our discretion.

Pricing and Availability

  • Price Changes: Prices for our products are subject to change without notice due to fluctuations in the gold, diamond, and other precious material markets. The price at the time of order confirmation applies, unless an error is identified.
  • Additional Charges: Additional fees may apply for customizations, such as sizing of rings or other jewelry, which will be communicated during the ordering process.
  • Availability: All items are subject to availability while supplies last. We reserve the right to limit quantities or discontinue products without notice.

3. Orders and Payments

Order Acceptance

Your placement of an order constitutes an offer to purchase. We reserve the right to accept or decline your order for any reason, including but not limited to product unavailability, errors in pricing or product information, or suspected fraud. If we decline your order, we will notify you and refund any payments made.

Payment

You agree to pay all charges associated with your order, including product costs, taxes, shipping fees, and any applicable customization fees (e.g., sizing). We use secure third-party payment processors to handle transactions, and we do not store full payment card details. All payments must be made in U.S. dollars.

4. Shipping, Returns, and Refunds

Our Shipping and Delivery Policy and Return and Exchange Policy govern the shipping, return, and refund processes. Key points include:

  • Shipping: We ship via UPS, FedEx, or USPS, and are not responsible for lost, stolen, damaged, or undelivered packages after transfer to the carrier. You must file claims with the carrier for such issues, as outlined in our Shipping and Delivery Policy.
  • Returns: Returns or exchanges require prior approval within 7 days of receipt, subject to a 10% restocking fee. Custom, sized, sale, final sale, discounted, or special order items (e.g., sized rings, engraved items, custom pendants, or nameplates) are non-returnable. 5. Intellectual Property

All content on the Services, including text, images, designs, logos, and product descriptions, is owned by or licensed to Candy Jewelers and protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.

6. Disclaimers and Limitation of Liability

No Warranties

To the fullest extent permitted by law, the Services and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free.
  • Product descriptions or images will be 100% accurate due to the limitations noted in Section 2.
  • Products will meet your expectations or be free from wear and tear during normal use.

As stated in our Authenticity Guarantee, gold is a soft metal susceptible to bending or damage during normal wear. We do not provide warranties against damage due to normal wear and tear but offer repair services or trade-in credits for eligible items.

Limitation of Liability

To the fullest extent permitted by law, Candy Jewelers, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from:

  • Your use of or inability to use the Services.
  • Errors or inaccuracies in product descriptions, pricing, or availability.
  • Loss, theft, or damage to products during shipping or after delivery.
  • Any unauthorized access to your account or data.

Our total liability for any claim arising from these Terms or the Services shall not exceed the amount paid by you for the product or service giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Candy Jewelers, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms or applicable law.
  • Your misuse of the Services.
  • Any content you submit, such as product reviews or user-generated content.

8. Dispute Resolution and Governing Law

Governing Law

These Terms and your use of the Services are governed by the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any disputes arising from these Terms or the Services.

Arbitration

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Los Angeles, California. You waive any right to participate in a class action lawsuit or class-wide arbitration. The arbitrator’s decision shall be final and binding, except as provided by law.

Limitation on Claims

Any claim or cause of action arising from your use of the Services must be filed within one (1) year after the claim arises, or it will be barred.

9. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, with or without notice, for any reason, including violation of these Terms, suspected fraud, or conduct that may harm us or other users. Upon termination, your account and right to use the Services will cease, but provisions such as Limitation of Liability, Indemnification, and Dispute Resolution will survive.

10. Miscellaneous

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Policies, constitute the entire agreement between you and Candy Jewelers regarding the Services, superseding any prior agreements.

Force Majeure

We are not liable for delays or failures to perform due to events beyond our reasonable control, such as natural disasters, supply chain disruptions, or governmental actions.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
